Medical devices supplier Smith & Nephew has won its appeal over a patent dispute with Kinetic Corporation. A court in Texas says that the wound management patents are "invalid due to obviousness". S&N has already won similar cases in the UK and Germany.Kinetic has 90% of the US market for the niche to which the patents refer. S&N has found it difficult to grow its market share because of the litigation. The products account for 2% of S&N's total revenues. There is a chance that other competitors could enter the market because of the ruling. Kinetic still has the chance to appeal. S&N will release its third quarter figures on 5 November. There has been no news from gaming software provider Cryptologic but the share price has slumped by nearly one-quarter. There are no reported trades and the few trades that there were on the Canadian market yesterday were the equivalent of a couple of hundred pounds each. The bid/offer spread is 50p/80p. At the end of September Cryptologic said it has reached a settlement with Marvel, which would allow it to use a wider range of comic book characters on a number of additional platforms. The agreement has been extended until January 2014. The non-exclusive agreement is at a lower cost to Cryptologic.
